- supranational law and
- interstate law.
The supranational law is made up of EC regulations, namely the Ordinances No 1408/71 and No 574/72. The particular
feature of supranational law is the fact that it is directly applicable without the need to be transposed into national
law by the German legislature.
The interstate law includes all agreements concluded between Germany and other states on social security containing
stipulations on accident insurance and the conventions of the International Labour Office (ILO) as far as they refer
to accident insurance. Prior to their application, these regulations need to be transposed into national law by the
German legislature.
The EC and the agreement legislation intend to co-ordinate the different national regulations on accident insurance
with regard to transnational matters. One example is the regular definition of the conditions under which people who
are only temporarily employed in another country have to be insured in this country or in their home country. The HVBG
expresses its opinion on general and specific matters as well as on court decisions on international accident insurance
and maintains a comprehensive service of circular letters for the accident insurance institutions.
